These Terms of Service govern your use of thestickerbitch.com and purchases made from The Sticker Bitch, a brand operated by The Defiant Dog LLC. Throughout these Terms, “we,” “us” and “our” refer to The Sticker Bitch and The Defiant Dog LLC.

By accessing our website, submitting artwork or placing an order, you agree to these Terms of Service, our Return and Refund Policy, Privacy Policy and Shipping Policy.

1. Online Store Terms

You must be legally capable of entering into a binding agreement to use this website or place an order. You may not use our products or services for an unlawful or unauthorized purpose.

You may not introduce viruses, malicious code or other harmful material to our website. You may not attempt to disrupt, damage or gain unauthorized access to the website, customer accounts or connected services.

2. Products and Services

We sell custom-printed stickers, labels, decals and related products. Product colors and appearance may vary slightly from images displayed on phones, monitors and other electronic devices.

We make reasonable efforts to describe products, materials, sizes and colors accurately. We do not guarantee that a device’s display will reproduce printed colors accurately.

Sticker dimensions are generally measured along the longest side unless otherwise stated. Minor variations in cutting, alignment, color and finished dimensions may occur within normal printing and production tolerances.

We reserve the right to modify or discontinue products, services, options and pricing without notice.

3. Orders

Submitting an order does not guarantee acceptance. We may refuse, limit or cancel an order for reasons including:

• Pricing or listing errors

• Suspected fraud or unauthorized payment

• Production limitations

• Prohibited or potentially infringing artwork

• Abusive or threatening conduct

• A request that violates these Terms or applicable law

If we cancel an order before production, any amount paid for the canceled portion will be refunded.

Customers are responsible for providing accurate billing, shipping, contact and order information. Please monitor the email address or account used during checkout for proof requests and order updates.

4. Custom Artwork and Personalization

You are responsible for supplying complete and accurate design instructions, including wording, spelling, colors, dimensions and requested imagery.

When you upload or submit artwork, logos, photographs, text or other materials, you confirm that:

• You own the material or have permission to use and reproduce it;

• Our use of the material to complete your order will not violate another party’s copyright, trademark, privacy, publicity or other rights; and

• The material does not violate applicable law.

You grant The Sticker Bitch and The Defiant Dog LLC a limited license to access, modify, reproduce and use the submitted materials solely as reasonably necessary to prepare proofs, manufacture your order, provide customer service and maintain required business records.

You retain ownership of customer-supplied artwork. We do not claim ownership of your preexisting logo or other materials.

5. Prohibited Content

We reserve the right to reject artwork or orders that include:

• Material that infringes intellectual-property rights;

• Unlawful threats, harassment or incitement to violence;

• Sexual exploitation or content involving minors;

• Fraudulent, deceptive or counterfeit material;

• Content prohibited by our payment processor, hosting provider or applicable law; or

• Any material we reasonably determine we cannot safely or lawfully produce.

Refusal to produce a design does not imply a judgment about the customer or any lawful viewpoint. When possible, payments for unproduced items will be refunded, except for nonrefundable design work already completed.

6. Proofs and Customer Approval

When a proof is provided, production will not begin until the customer approves it.

Customers must review all wording, spelling, colors, placement, dimensions and other details. Approval confirms that the design is ready for production.

We are not responsible for errors that were visible in an approved proof. Changes requested after approval may require an additional charge and may not be possible once production begins.

Production and delivery estimates may be delayed if proof approval or requested information is not received promptly.

7. Design Services

Paid design services include only the concepts, revisions and deliverables described in the applicable product listing or written quote.

Unless otherwise agreed in writing:

• Design fees become nonrefundable once design work begins;

• Additional concepts or revisions may require additional payment;

• Editable source files are not included;

• Purchasing a sticker design does not automatically include a complete business logo or brand identity; and

• Final commercial-use rights apply only after full payment.

We may retain ownership of preliminary concepts, unused drafts, working files and design elements not selected or purchased by the customer.

8. Pricing and Payment

Prices are displayed in U.S. dollars unless otherwise stated. Applicable taxes, shipping charges and other fees are calculated during checkout.

Full payment is required before production unless we approve different terms in writing. We may correct pricing, description or calculation errors and contact you before proceeding with an affected order.

Discounts and promotional codes are subject to their stated conditions and may not be combined unless expressly permitted.

9. Sales Tax

Applicable sales tax will be collected based on the order and delivery information provided during checkout and the requirements of relevant tax jurisdictions.

Customers purchasing qualifying products for resale or exempt use must provide valid exemption documentation before completing the applicable purchase. We cannot retroactively remove properly charged sales tax merely because documentation was not supplied before the transaction.

10. Processing and Shipping

Processing times are estimates and may begin only after payment, receipt of usable artwork and final proof approval.

Delivery estimates are not guarantees. We are not responsible for carrier delays, weather events, service interruptions or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address. Additional shipping charges may apply when an order must be resent because of an incorrect address supplied by the customer.

11. Returns, Cancellations and Refunds

Custom and personalized products are made specifically for each customer and generally cannot be returned or exchanged because of a change of mind.

Cancellation eligibility depends on whether artwork preparation, design or production has begun. Orders containing defects, production errors or shipping damage will be handled according to our Return and Refund Policy.

Our Return and Refund Policy is incorporated into these Terms by reference.

12. Website Information

We make reasonable efforts to keep information accurate and current, but we do not warrant that website content will always be complete, error-free or current.

Information provided through the website is for general informational purposes and should not be relied upon as professional legal, financial or technical advice.

We may update or correct website content at any time without prior notice.

13. Third-Party Services and Links

Our store may use or link to third-party services, including Shopify, payment processors, shipping carriers, design tools and social-media platforms.

We are not responsible for the availability, content, privacy practices or performance of independent third-party services. Your use of those services may be governed by their own terms and policies.

14. Reviews, Feedback and Submissions

If you voluntarily provide a review, testimonial, photograph or other feedback, you grant us permission to use, reproduce and display that submission for business and promotional purposes unless you ask us not to.

We will not knowingly publish confidential customer information. We may remove submissions that are unlawful, abusive, deceptive or infringing.

15. Disclaimer of Warranties

To the extent permitted by law, the website and services are provided on an “as available” basis. We do not guarantee uninterrupted access to the website or that every product will be suitable for every surface, environment or application.

Surface condition, installation method, exposure, cleaning products, temperature and other factors outside our control can affect sticker performance.

Nothing in these Terms limits any warranty or consumer right that cannot legally be excluded.

16. Limitation of Liability

To the fullest extent permitted by applicable law, The Sticker Bitch and The Defiant Dog LLC will not be liable for indirect, incidental, special, consequential or punitive damages arising from use of the website, products or services.

Our total liability relating to an order will not exceed the amount paid for the product or service giving rise to the claim.

These limitations do not apply where prohibited by law.

17. Indemnification

You agree to indemnify and hold harmless The Sticker Bitch, The Defiant Dog LLC and their representatives from claims, losses, liabilities and reasonable expenses arising from:

• Artwork or materials you submitted;

• Your violation of another party’s intellectual-property or other legal rights;

• Your unlawful use of our products or services; or

• Your material violation of these Terms.

18. Governing Law

These Terms are governed by the laws of the State of New Jersey and applicable federal law, without regard to conflict-of-law principles.

Nothing in this section prevents a consumer from exercising rights available under applicable consumer-protection law.

19. Severability

If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.

20. No Waiver

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

21. Changes to These Terms

We may update these Terms periodically by posting a revised version on this page. Changes become effective when posted unless otherwise stated.

Your continued use of the website after an update constitutes acceptance of the revised Terms.
